Drunk Driving Defense
In California, it is illegal to operate a vehicle with either, (1) alcohol level of .08 or higher or (2) under the influence of another narcotic or drug. After being charged with a DUI, you face criminal charges and suspension of your driver’s license. Criminal punishments for a DUI include: jail, probation, court ordered rehabilitation, and fines, amongst many others. Punishments may be even more severe if you have two or more DUIs, if you have a minor under the age of 14 in your vehicle, or if you caused injury to other persons.
You have a right to an attorney for a DUI offense. DUI charges can be confusing because you have a case both in criminal court and another case with the Department of Motor Vehicles (DMV). It is important to be represented by an experienced DUI defense attorney who is familiar with the process to help you navigate the court system and the DMV. The attorneys at Romero and Associates are very experienced with DUI defense, and have received many favorable outcomes for our clients.
Drunk Driving Charges
DUI Arrests in Los Angeles usually begin with a traffic stop by a highway patrol officer, or in some cases, occur at a sobriety checkpoint. The officer may ask you to perform a series of maneuvers intended to determine whether you are intoxicated or not. These are called field sobriety tests. Officers may also have you blow twice into a handheld breathalyzer.
Once arrested, you will be taken to the holding cell and asked to take a 2nd test to determine your BAC or Blood Alcohol Content. This usually takes the form of a blood or breath test at the police station, jail or hospital (you’re required by law to take this test…refusing the chemical test may result in tougher California DUI penalties and a one-year drivers license suspension).
Most DUI arrests that are misdemeanors. Usually first offenses and DUI arrests that do not involve an accident of any sort, will end with your release from jail within a few hours of your arrest and booking. You will be given two documents when released, a citation to appear in court, and a temporary license to operate a motor vehicle (the police will keep your actual license). If you’re from out of state and get a California DUI, the police here can’t take your physical license.
There are many levels of DUI charges. They range from first time, misdemeanor offenses, to more serious felony offenses that are the result of a an automobile accident (sometimes even a fatal accident). The more serious the infraction, the more important it is that you contact a DUI defense attorney that can represent your interests in court.

DUI Frequently Asked Questions
Q: I failed a breath test, do I have a chance to beat my case?
A: Absolutely. Breath Tests are notoriously unreliable. The device may malfunction or the officer operating it may make an error. Your health condition can also be brought into question as can the immediate surrounding where the test was administered. An experienced DUI attorney will know what questions to ask and how to attack the validity of a positive breat test.
Q: I failed a blood test and have been told they’re full proof. Can I still win my case?
A: Blood tests are anything but full proof. Tainted test results from blood fermentation, the improper handling or care of blood samples, and blood contamination can all lead to a false positive. Only an experienced DUI attorney will know whether your situation requires greater scrutiny.
Q: I was arrested at a sobriety checkpoint. Does this change the disposition of my case?
A: It absolutely does. Sobriety checkpoints have their own sets of rules and regulations they must adhere to. A qualified drunk driving attorney will know to find out if superior officers were responsible for organizing and monitoring the checkpoint? Did all officers performing stops make sure that they follow a predetermined formula for stopping cars and was the DUI roadblock publicly advertised?
There are literally thousands of different scenarios and defense possibilities for a DUI stop. Jose Romero has the experience and knowledge to ask the proper questions and investigate your case fully and diligently, helping to insure the best possible result.
